EU Commission Opens Antitrust Investigation into Google's Use of Publisher and YouTube Content for AI
The European Commission has initiated a formal antitrust investigation into Google's use of content from web publishers and YouTube creators to power its artificial intelligence (AI) services. The probe aims to determine whether Google's reliance on publishers' content, particularly in its AI Overviews and AI Mode features, involves appropriate compensation or consent.
The investigation will assess if publishers are fairly remunerated or if they can refuse the use of their content without facing negative impacts on their visibility in Google Search. It also examines the rights of YouTube creators whose content is used for AI training without compensation, while competitors are prohibited from accessing the same materials.
This inquiry is a part of broader EU regulatory scrutiny of large digital platforms, following previous actions against Google including Digital Markets Act proceedings relating to publisher website access and a €2.95 billion fine for self-preferencing in ad technology. Brussels has also recently opened an investigation into Meta's AI policy changes on WhatsApp.
Alex Chandra from IGNOS Law Alliance commented that the Commission's move reflects a wider ambition to subject digital business models with global reach to the EU regulatory framework. Meanwhile, Teresa Ribera, EU Executive Vice-President for Clean, Just and Competitive Transition, emphasized that progress in AI development should not compromise core societal principles.
The European Commission has prioritized this investigation but has not announced a deadline for its conclusion.
