The European Commission has launched an antitrust investigation into Google's use of online content from publishers and YouTube creators for its Gemini AI model and other AI services to evaluate compliance with EU competition laws.

The probe aims to determine whether Google distorts competition by imposing unfair terms or granting itself privileged access to content, potentially disadvantaging rival AI developers. Concerns include whether Google has utilized web publishers' content to power AI in search results without fair compensation or consent, and whether YouTube content was used to train generative AI models without compensation or the option to refuse.

Publishers reportedly grant Google permission to use their data for training purposes. Meanwhile, YouTube prohibits third-party use of videos for AI training unless a content creator activates a setting allowing such use. YouTube also stated that content is used to improve product experience, including machine learning and AI.

In June, CNBC reported Google had trained Gemini and Veo3 AI models on YouTube videos. Google confirmed it used a subset of videos for training, while YouTube reiterated its use of content for product experience improvements involving machine learning and AI.

EU competition chief Teresa Ribera emphasized that while AI brings significant benefits, progress should not come at the expense of fundamental societal principles.

Google responded by warning the complaint risks stifling innovation and stressed that Europeans should benefit from the latest technologies. The company also said it would collaborate with news and creative industries during the AI transition.

This investigation is part of a wider wave of EU actions against US tech firms, including a €3 billion fine against Google in September for abusive practices in digital advertising. The EU has also targeted Meta regarding AI features in WhatsApp.
