Judge Requests Clarifications Ahead of Do Kwon's Sentencing Scheduled for December 11, 2025
Do Kwon, the founder of Terraform Labs, is set for sentencing on December 11, 2025, and faces up to 12 years in prison. The Terraform Labs collapse, which once had a peak market value above $50 billion, was a critical event that contributed to the downturn in the crypto market in 2022.
U.S. District Judge Paul A. Engelmayer of the Southern District of New York has posed six detailed questions regarding the sentencing process. Among these questions are issues concerning Kwon’s potential extradition to South Korea and assurances that he would not be released if transferred abroad. The judge also asked if Kwon’s victims will have the opportunity to be heard at sentencing and how a victim-compensation process would function.
Further inquiries include clarity on credit for roughly 17 months Kwon spent in Montenegrin custody, any remaining charges in South Korea, how victim compensation would be administered, federal sentence-reduction credits, and whether supervised release following incarceration is appropriate.
Prosecutors are seeking a 12-year prison sentence while Kwon’s defense team is requesting a five-year term. Responses to the judge’s questions are due by December 10, 2025, a day before the scheduled sentencing.
