Kilmar Abrego Garcia Appears at ICE Check-In After Release, Vows to Continue Fight Against Trump Administration
Kilmar Abrego Garcia appeared for a check-in at a Baltimore ICE facility following his release from federal custody and pledged to continue fighting the Trump administration.
U.S. District Judge Paula Xinis ordered Abrego Garcia released from the ICE Moshannon Valley Processing Center in Philipsburg, Pennsylvania, noting that the final removal order needed to deport him to a third country had not been issued.
Abrego Garcia’s attorney obtained a temporary restraining order preventing his rearrest at the check-in, with Judge Xinis granting the order around 7:30 a.m.
The Justice Department plans to challenge Xinis’ order, and White House spokesperson Karoline Leavitt said the administration would appeal, calling the order activist.
Department of Homeland Security spokesperson Tricia McLaughlin criticized the order as naked judicial activism by an Obama-appointed judge and said the administration will continue to fight it in court.
Background includes Abrego Garcia’s March deportation to El Salvador, subsequent detention and release order issues, prior attempts to deport him to Liberia, Eswatini, Uganda, and Ghana, and earlier human smuggling charges related to a 2022 traffic stop.
