Republican Governors' Actions Against Muslim Advocacy Groups Raise Free Speech Concerns
In recent months, the states of Texas and Florida have taken significant legal steps to restrict Muslim advocacy organizations. Texas designated the Council on American-Islamic Relations (CAIR) and the Muslim Brotherhood as foreign terrorist and transnational criminal organizations in November, an order which bars these groups from acquiring property and authorizes the attorney general to sue to shut them down. Florida followed with a similar order in early December, restricting CAIR and related individuals from state contracts, employment, or funding.
CAIR has responded by filing lawsuits in both states, arguing that the orders are unconstitutional and defamatory. Edward Ahmed Mitchell of CAIR expressed concerns that the designations threaten free speech and due process, could enable broad political targeting, and suggested they are publicity stunts aimed at smearing the organization. He emphasized that CAIR operates independently and denies any ties to Hamas or the Muslim Brotherhood despite the government designations.
Conservative politicians have long opposed CAIR, with Senator Marco Rubio indicating that federal-level orders targeting such groups are forthcoming. Mitchell also highlighted a broader rise in anti-Muslim bigotry since 9/11, which has surged following the Hamas attacks in October 2023 and the subsequent Israel-Gaza war, affecting areas such as education, employment, harassment, vandalism, and violence.
