Sean 'Diddy' Combs Files Expedited Appeal Over Prostitution-Related Convictions
Sean 'Diddy' Combs has filed an expedited appeal with the Second Circuit seeking immediate release and to overturn his two prostitution-related convictions. His attorney, Alexandra Shapiro, described the 50-month sentence as unlawful, unconstitutional, and a perversion of justice, requesting resentencing if the convictions are not entirely reversed.
The appeal is being pursued through the Southern District of New York (SDNY), which declined to comment on the matter. During the trial, testimony included that of ex-girlfriends Cassie Ventura and a Jane Doe. The jury acquitted Combs of racketeering conspiracy and sex trafficking charges, but convicted him on two counts of transportation to engage in prostitution.
In September, Combs sought acquittal or a new trial over the use of the Mann Act, but this bid was unsuccessful. US District Judge Arun Subramanian sentenced Combs to 50 months in prison, despite prosecutors seeking at least 11 years. The judge stated that a history of good works cannot erase the record.
The appeal filing argues that the judge did not properly follow sentencing guidelines, disregarded new guidelines, and improperly considered acquitted conduct, effectively acting as a "thirteenth juror" and delivering a draconian sentence. Combs apologized in court before sentencing to Cassie Ventura and Jane Doe for his actions.
He currently faces dozens of pending civil lawsuits alleging sexual assault, rape, and exploitation, with some claims that he or his associates drugged people. His representatives maintain that he never assaulted or trafficked anyone.
